These Terms of Service (“Terms”) govern your use of the Kashmir Travel Company website and the travel services we offer from Srinagar, Jammu & Kashmir, India. By submitting an enquiry, requesting a quote, or confirming a booking, you agree to these Terms and our Privacy Policy.

1. Who we are

Kashmir Travel Company designs and operates Kashmir holidays, transfers, and related concierge services. Contact: info@kashmirtravelcompany.com.

2. Quotes versus confirmed bookings

  • Quotes and outlines (including AI-assisted plans and enquire responses) are indicative only. Prices, availability, hotel categories, and inclusions may change until we issue a written confirmation.
  • A booking is confirmed only when we send written confirmation (email or message) stating dates, inclusions, price, and payment terms, and any required deposit or full payment has been received as agreed.
  • Until confirmation, either party may decline or revise without liability for the unconfirmed outline.

3. Payments

  • Payment amounts, due dates, and methods are set out in your confirmation or invoice.
  • Deposits are typically required to hold hotels and transport; the balance is due by the date we specify (often before travel or on arrival, as agreed in writing).
  • Bank transfer, UPI, or other channels we designate may be used. You are responsible for accurate payment references and any bank fees on your side.
  • Failure to pay on time may result in cancellation of holds and forfeiture of non-refundable supplier deposits as described in your confirmation and our Travel Policies.

4. Cancellation, changes, and refunds

Cancellation windows, change fees, and refunds depend on supplier rules and how far in advance you cancel. Those details are summarised in our Travel Policies and confirmed on your final itinerary. Weather- or safety-driven replans are handled as described in the policies and section 6 below.

5. Your responsibilities

  • Provide accurate passenger names, contact details, and travel documents.
  • Hold valid ID, permits, and any visas required for your journey.
  • Follow local laws, hotel rules, and reasonable safety instructions from guides or drivers.
  • Arrive on time for pickups; delays may affect the day’s plan without obligation on us to refund unused segments.

6. Kashmir road, weather, and safety advisories

Travel in Kashmir involves mountain roads, seasonal snow, landslides, fog, high-altitude conditions, and occasional administrative or security restrictions. Gondola, meadow, and pass access can close with little notice. We plan buffers and will replan where safety or access requires. Such changes are not a breach of these Terms when made in good faith for safety or lawful order. Refunds for unused components follow supplier rules and our policies.

7. Liability limits

  • We arrange services with care but are not liable for acts or omissions of independent hotels, airlines, or other third-party suppliers beyond amounts we can reasonably recover from them.
  • To the fullest extent permitted by Indian law, our total liability arising from a booking is limited to the amount you paid us for the affected services.
  • We are not liable for indirect, incidental, or consequential losses (including lost enjoyment, missed connections outside our control, or business loss), except where liability cannot be excluded by law.
  • Nothing in these Terms excludes liability for fraud, wilful misconduct, or death or personal injury caused by our negligence where such exclusion is prohibited.

8. Force majeure

We are not liable for failure or delay caused by events beyond reasonable control, including but not limited to extreme weather, natural disasters, road or airport closures, strikes, epidemics, government orders, unrest, or utility failures. We will use reasonable efforts to replan or assist with alternatives; refunds remain subject to supplier policies and amounts we actually recover.

9. Intellectual property

Website content, branding, itineraries we create, photography we own, and AI-assisted outlines we provide remain our intellectual property (or that of our licensors). You may use trip documents for your personal travel. You may not copy, republish, or commercialise our content without written permission.

10. Website use

You agree not to misuse the site (including scraping, injecting malware, or submitting false enquiries). We may suspend access that threatens security or abuse prevention.

11. Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory consumer protections, courts at Srinagar, Jammu & Kashmir shall have exclusive jurisdiction over disputes arising from these Terms or your booking.

12. Changes

We may update these Terms by posting a revised version on this page. Confirmed bookings remain subject to the terms in force at confirmation unless a change is required by law or agreed in writing.
